NATION IN BRIEF : NEW JERSEY : Court Upholds Use of Breathalyzer Tests

The New Jersey Supreme Court upheld the use of Breathalyzer devices in a case that could set a national precedent, rejecting arguments that the devices are not a reliable means of determining whether a motorist is driving under the influence of alcohol. The court ruled 5 to 1 against four motorists charged with drunk driving who sought to introduce expert testimony on the accuracy of the devices at their trials. The cases will now proceed in Municipal Court. “The Breathalyzer reads alcohol with unimpeachable accuracy,” Justice Marie Garibaldi wrote for the majority.
