Suit Over Printing Photo of Slain Man’s Body Dismissed

LOUISVILLE, Ky. —
A judge dismissed a lawsuit filed by a shooting victim’s family against the Courier-Journal over a front-page photo of the body.
A mentally disturbed man killed Richard O. Barger and eight others and wounded 12 in a rampage with an assault rifle at a printing plant on Sept. 14. The rampage ended when the gunman killed himself.
Circuit Judge Benjamin Shobe accepted First Amendment arguments from the newspaper in deciding Tuesday to throw out the lawsuit, in which the Barger family sought unspecified damages.
