P.M. BRIEFING : Oil Workers’ Bias Suit Refused

The Supreme Court today refused to revive a 14-year-old lawsuit by a Texas oil refinery’s black employees who say they are victims of racial discrimination.

The court, without comment, left intact a ruling that dismissed the suit against a union and Gulf Oil Corp.

The U.S. 5th Circuit Court of Appeals in December threw out the 1976 suit by employees at a Gulf Oil refinery in Port Arthur.

The appeals court said a federal judge who ruled against the workers “was not clearly erroneous” in deciding that revised seniority and promotion rules at the refinery did not discriminate intentionally against blacks.
