Victim of S.D. Police Shooting Is Awarded $169,789

The San Diego City Council awarded $169,789 Tuesday to the 31-year-old victim of a police shooting that occurred more than a year ago.

Kevin W. Baxter was shot by San Diego police in his home, in the 4800 block of Orange Avenue, after lunging for a gun early on the morning of March 6, 1989.

Baxter’s neighbor had called police that night complaining about noise.

Officers Terrance Johnson and Jamal Pasha arrived at Baxter’s home and found him standing in semi-darkeness by his front door.

Pasha told Baxter to drop the .38-caliber gun in his hand.

After dropping the gun, Baxter lunged for the weapon and Johnson fired five shots, hitting the Baxter in the abdomen, arm and leg.

Baxter sued the city and City Council members voted to award him the money in closed session Jan. 15 and ratified that decision in a open meeting Tuesday.
