The Oregon Court of Appeals upheld an $11.1-million damage award against the designer and manufacturer of a football helmet worn by a high school student when he was severely injured.
A Multnomah County Circuit Court jury in October, 1989, awarded the damages, through his parents, to Richard Austria and against the Bike Athletic Co. and Kendall Research Center.
Bike manufactured and marketed the “Air Power” helmet involved. It was designed by Kendall Research Center.
Austria, then 16, was injured when a player’s knee smashed into his helmet during a 1985 practice. He suffered from brain swelling that has left him seriously impaired physically and mentally.
