Apple Wins Preliminary Rulings: A federal judge in San Francisco threw out several claims raised by Microsoft Corp. and Hewlett-Packard Co. in response to a copyright suit by Apple Computer Inc. over its Macintosh display technology. In pretrial rulings, U.S. District Judge Vaughn Walker said Microsoft and Hewlett-Packard would not be allowed to argue at trial that the Macintosh pictorial window displays lacked the originality needed for copyright protection. He also ruled that Apple’s suit did not violate a promise in the 1985 Microsoft licensing contract that Apple would not sue over a particular version of the Windows program. Walker said the promise did not extend to the Windows version that was the focus of the current suit.
