Product Liability Suit Against Collagen Dropped: Palo Alto-based Collagen Corp. announced that Marlene Waller dropped her lawsuit in which she claimed that injectable collagen treatments caused her to develop scleroderma and that a federal court in Texas denied the motion for a new trial of a Houston woman who alleged that collagen injections caused her to develop a rare autoimmune disease. Circuit Court Judge Joseph N. Casciato of Cook County, Ill., granted Waller’s request for a voluntary dismissal without prejudice of her case against Collagen Corp. In Houston, a U.S. District Court judge denied plaintiff Jennifer Stamps’ motion for a new trial. In October, 1991, the same court ruled that her claims regarding the company’s allegedly defective manufacturing, labeling and warning were preempted by Medical Device Amendments to the Food, Drug and Cosmetic Act.
