VENTURA : Molester Punches Attorney at Hearing

A convicted child molester who had just been sentenced to 23 years in prison punched his attorney in the face Friday in Ventura County Superior Court.

Assistant Public Defender Duane Dammeyer said he will not press charges against his client, Gary Boyer, of Ventura, who was quickly subdued by other attorneys and bailiffs after the incident.

Judge Charles W. McGrath had just sentenced Boyer and ordered him to submit blood and urine samples for an AIDS test when Boyer rolled his chair back from the defense table, Dammeyer said.

“He said, ‘Nobody’s taking nothing,’ and I thought he was going to huff off to the anteroom, and instead he just hit me in the head,” Dammeyer said. “I was telling him to be quiet. He said, ‘You don’t have to do the time.’ ”

Deputy Tim May, the courtroom bailiff, said he helped the others hustle Boyer into the anteroom. There, he was strapped to a stretcher for transportation to the jail infirmary, where he was treated for a back injury.

Dammeyer said he was not hurt in the attack.
