Countywide : Rent Increase Limit Given Tentative OK
The County Board of Supervisors tentatively approved Tuesday a new ordinance that will limit the rent increase allowed to park owners when a mobile home is sold to 15% or $50, whichever is less.
The U.S. Supreme Court ruled recently that local rent controls apply even when mobile home tenants sell their homes and park spaces to new buyers.
And, urged on by several homeowners, the supervisors voted unanimously Tuesday to follow the rent controls recommended by County Counsel James McBride.
If governments go so far in restricting increases that they impose a disproportionate burden on park owners to provide low-cost housing, then the courts could still rule that government has taken the owners’ property and must be compensated, McBride said.
However, McBride said, “we think 15% allows a reasonable return and it should be supportable” if challenged in court.
A final vote on the ordinance is set for next Tuesday.
