Duarte : Gas Station Permit Revoked

The City Council revoked a conditional-use permit Tuesday for a local gas station that has operated for 21 months without meeting terms imposed on its operation, but the council agreed to delay litigation for 120 days to allow the owner time to comply.

The Planning Commission originally granted the permit to Shabash Melikian in October, 1990, for the Texaco station at 2307 E. Huntington Drive. But Director of Community Development Ed Cox said the owner has not complied with seven of the 25 conditions.

For example, Melikian has failed block a driveway that is too close to the corner and has yet to re-coat and provide lighting for a parking lot.

Melikian said the $15,000 loan he needs to satisfy Planning Commission requirements has been delayed by his bank for six months. He said he is trying to sell the property.

Council members said they were sympathetic, and they discussed various options for compliance. However, Mayor Ginny Joyce said granting further extensions would be unfair to other gas station owners who have satisfied similar permit provisions in a more timely fashion.
