SPECIAL TO THE TIMES

Prosecutors want an expert on serial murders to testify during the upcoming trial of Cleophus Prince Jr. because a unique “calling card” indicates that one person killed six women in 1990 and 1991, according to documents filed Tuesday.

Prince is scheduled to go on trial Nov. 30 on charges of murdering six women during a string of attacks that terrorized Clairemont and University City. If convicted, Prince could be sentenced to die in the gas chamber at San Quentin.

Deputy Dist. Attys. Daniel Lamborn and Rick Clabby want Superior Court Judge Michael D. Wellington to authorize the testimony of FBI Special Agent John Douglas, an expert on crime scene analysis and “signature crimes.”

Douglas will not identify Prince as the killer of the six women, the document reads, but he will link one person to the slayings by discussing an unspecified “calling card” that is “a constant and enduring part of the killer.”

Prosecutors say DNA evidence links Prince to the crimes, but defense attorneys will vigorously object to this evidence being put before a jury. Furthermore, the document indicates that the DNA tests do not tie Prince to every murder.

The prosecution memorandum is the first salvo in the second round of motions in the case. During earlier hearings, Wellington ruled that certain key prosecution evidence--such as items found in Prince’s car when he was arrested--can be shown to a jury.

Hearings will begin Sept. 29 to determine if Douglas will be allowed to testify and if a “bloodstain pattern analysis” expert can present evidence of strange drips left on the victims’ upper thighs.

Attorneys will also discuss if the defense will be allowed to present evidence indicating that Tiffany Schultz, the first victim in the series, had a stormy and sometimes violent relationship with her boyfriend, Christopher Burns, who was at first arrested as a suspect. During Prince’s preliminary hearing in March, Prince’s attorneys asked Burns questions that suggested that he killed his girlfriend.

The defense will also ask Wellington to order that the trial be moved to another city during hearings scheduled to begin Nov. 5.
