Justice Refuses to Block Toxic Waste Incinerator

Supreme Court Justice John Paul Stevens refused Monday to block commercial operation of a controversial hazardous waste incinerator near East Liverpool, Ohio.

Opponents of the $160-million incinerator, led by the environmental group Greenpeace and local residents, had asked for an emergency order preventing commercial operation. They cited the threat of “irreparable harm.”

But Stevens turned down their request without any comment, leaving intact an order by a federal appeals court last week that cleared the way for the incinerator to begin operations.

His action was a victory for Waste Technologies Inc., a subsidiary of Von Roll AG of Switzerland and the owner of the facility.
