California SunCare Accused of Price-Fixing: The Department of Justice’s antitrust division and the Los Angeles-based manufacturer agreed to a consent decree that will prohibit the company from setting a minimum resale price for its indoor tanning products. The Justice Department alleged that California SunCare set a floor price below which its distributors could not sell its products. But Richard Spencer, an attorney for California SunCare, denied the charge, saying the company agreed to the settlement--under which the company does not admit wrongdoing--to head off a lengthy and expensive court battle. “The company was entitled to, and even under the consent decree can, suggest minimum prices,” Spencer said. The settlement must be approved by the court.
