An Italian judge who sentenced a man to 24 years in jail for a Mafia murder was unaware of a small hitch that would stop his going to prison: the defendant was dead.

The judge in the northern city of Turin who sentenced gangster Tommaso Ceraudo last month, said it was not his fault--he did not know he was convicting a corpse.

Ceraudo, a member of the feared Calabrian Mafia, was gunned down in a gangland shooting last November--two months before his sentencing Jan. 28 for a 1990 murder.
