FOUNTAIN VALLEY : Adult Businesses Ban Extended Up to a Year

A moratorium on adult entertainment businesses in the city was extended by the City Council for up to 12 months.

The council Tuesday approved the extension because city officials need more time to complete a study on the issue.

Councilman John Collins said cities cannot prohibit adult entertainment businesses, but they can specify where they are located.

“This is a double-edged sword,” Collins said. “We’ve always been on the leading edge to protect public decency and family values, yet we can only push the edge of that envelope so far until we run into First Amendment rights.”

The council approved a 45-day ordinance Feb. 15, 1994, to prohibit adult entertainment business, such as nude and topless clubs and adult bookstores, from operating in the city. The moratorium expires Wednesday.

Last year, the city received an inquiry regarding the establishment of a nude dance club, prompting city officials to revisit the code.
