Quiksilver Contractor Accused of Violations : Labor: The Costa Mesa sportswear maker was cited earlier this week, as was another of its contractors.

A second Quiksilver Inc. contractor has been cited for alleged labor law abuses, resulting in the confiscation of more clothes and compounding headaches for Quiksilver, which itself was fined earlier this week by labor inspectors.

State inspection reports obtained Thursday show that investigators issued penalties totaling $19,500 against Calway Enterprises in Westminster for failing to register as a garment contractor and for allegedly violating regulations on cash pay, minimum wage and record keeping.

Federal labor officials, who joined the raid of Calway this week, also are expected to demand Calway pay its workers a total of roughly $50,000 for unpaid overtime and minimum wages, officials said.

Tina Pham, Calway’s attorney, said the company recently mailed a registration application. Calway’s president, Tony Nguyen, generally denied the company violated other labor laws, saying his workers have typically earned $200 or more a week.

But state inspectors said some Calway workers told them they made from $69 to $120 for 40 or more hours of work a week. One elderly worker reported earning as little as $10 for a full day’s work, federal and state officials said in an interview.

The state’s inspection report, obtained under the Public Records Act, also showed that investigators confiscated 1,596 pieces of Quiksilver swimwear from Calway’s facility.

Earlier this week, federal and state labor officials raided and confiscated clothes from another Quiksilver contractor, a smaller shop in Garden Grove called Survival. That firm faces fines of about $28,000.

The allegations against Survival and Calway have embarrassed Quiksilver, a well-known manufacturer of sportswear based in Costa Mesa. Quiksilver, which last year reported revenue of $126 million, uses about two dozen contractors.

Earlier this week, Quiksilver itself was fined $21,800 for failing to register as a garment manufacturer.

Both garment manufacturers and contractors are required to register with the state, and the licenses must be renewed annually.

A spokesman for Quiksilver admitted Thursday that the manufacturer failed to renew its registration with the state. The spokesman, attorney Dwight Armstrong, said Quiksilver was taking steps to improve its requirements and monitoring of contractors.
