High Court Refuses to Lift Order on P&G; Suit: A Supreme Court justice refused to let BusinessWeek publish a story based on sealed court documents, despite the magazine’s claim that the restriction violates the First Amendment. Justice John Paul Stevens turned down an emergency request aimed at lifting the order of U.S. District Judge John Feikens. McGraw-Hill Inc., the publisher of BusinessWeek, contends the judge’s order is an unconstitutional “prior restraint” on publication that has already held up the story for two editions. The story is about a legal dispute between Cincinnati-based Procter & Gamble and Bankers Trust of New York. Stevens said the “wiser course” is to first let Feikens--and then a federal appeals court--decide whether to lift the order.
