Mediation a Quick and Inexpensive Solution

Regarding the Nov. 5 “Property Values” column by Ron Galperin (“Building-Defect Law Says Talk Before You Sue”): Mediation is often a mystery to the public. When properly applied, it is a useful tool that resolves the cases quickly, efficiently and inexpensively compared with litigation.

Regrettably, a 90-day moratorium is unlikely to avoid litigation. Because the filing deadline remains, 90 days is barely enough time to place the appropriate parties and their insurers on notice. The hiatus will, however, begin the investigation process and lead to an earlier resolution of the dispute. With the use of a mediator, designated as a referee, the investigation (called “discovery” in a suit) will be directed, orderly and designed to obtain sufficient information to bring the parties to the table with realistic repair solutions.
