Gun Club Suit Challenging Pistol Ban Is Thrown Out

West Hollywood’s ban on the sale of cheap pistols known as Saturday night specials passed its first legal challenge Monday when a Superior Court judge dismissed a gun club’s lawsuit before trial.

The California Rifle and Pistol Assn. sued West Hollywood and its City Council earlier this year, seeking a judicial order to block the decision to ban the guns. But Judge David Horowitz ruled Monday that the lawsuit contained “no . . . issues of material fact,” and threw the case out.

C. D. “Chuck” Mitchell, attorney for the rifle and pistol club, said the fight will continue in the appeals court.

The ban, the first of its kind in California, makes it a misdemeanor to sell Saturday night specials in West Hollywood.
