Potential Appeals

Rulings by Judge Hiroshi Fujisaki that experts say could be grounds for appealing the civil trial verdicts:
TESTIMONY ALLOWED
* An operator of battered women’s hotline said a woman named “Nicole” called to say she had been beaten and was being stalked by her famous husband.
* Jurors saw an undated letter in which Nicole Simpson said Simpson “beat the holy hell out of me.”
* Questions on whether Simpson flunked a lie-detector test.
* Al Cowlings told jurors about a 1989 conversation in which Nicole confided that O.J. Simpson hit her and pulled her hair during a nasty fight.
TESTIMONY EXCLUDED
* Former LAPD Det. Mark Fuhrman’s criminal trial testimony was not allowed.
* Simpson’s lawyers were allowed to contend that some evidence was planted, but blanket allegations of a massive frame-up were not permitted.
THE JURY
* The judge did not hold a hearing on whether the juror removed for a possible conflict of interest poisoned the thinking of the rest of the jury.
WHATS NEXT
The defense has several options:
* Ask for a new trial on grounds of alleged juror misconduct, disputed testimony and evidence, and amount of damage award.
* Ask for damages to be reduced.
* If the judge denies motions, appeal to a higher court.
* To file an appeal, Simpson must post a bond equal to 150% of the total damage awards $50.25 million. If he declares bankruptcy, he does not have to post bond.
