City Tightening Limits on Adult Businesses

Proprietors who want to open adult businesses in the city will face a new, more stringent permit process.
City Council members Monday unanimously gave preliminary approval to an ordinance specifying how far such businesses must be from churches, homes and schools.
Another section of the local law requires that adult businesses must also be separated from each other to prevent a “concentration” of adult activities in any one part of the city.
City Atty. James L. Markman said the ordinance is based on a similar Dallas law recently reviewed by the U.S. Supreme Court and found to be constitutional.
“Adult uses are constitutionally protected rights,” Markman said.
“We do have to leave these [proprietors] with viable business opportunities.”
Final approval of the ordinance is expected next month.
