New York native Lori Berenson, 28, who was sentenced to life in prison for treason by a hooded military judge, will not receive a new trial as U.S. officials have requested, Peru’s military said.

Berenson was convicted in 1996 of helping leftist Tupac Amaru Revolutionary Movement rebels plan a thwarted assault on Peru’s Congress. Peru’s Supreme Military Tribunal ruled that her case falls within the jurisdiction of the military justice system and that the request for a civilian trial is unfounded.

U.S. officials and Berenson’s family say her lawyer was not allowed to challenge evidence or cross-examine witnesses in the military court.
