Judge Wants More Time on Election Funding Case

Attorneys for Mayor Tom Daly and former Councilman Irv Pickler urged a Municipal Court judge Friday to dismiss charges of campaign finance law violations against the pair.

After a lengthy hearing, North Municipal Court Judge Gregg L. Prickett set a May 26 hearing to further consider the case.

A city-hired special prosecutor filed misdemeanor charges earlier this year against Daly, his treasurer and Pickler, stemming from efforts to finance a telephone bank for two City Council candidates during the 1996 election.

Attorneys for the defendants contend the special prosecutor lacked the authority to file the charges; the politicians also have denied any violations.

An attorney for the city urged the judge to permit the prosecution to move forward. He said in court documents that the special prosecutor had not only the right but the duty to prosecute.
