A Superior Court judge has ruled for the defendant in a case that pitted what he called a “dissident minority” against the Turtle Rock Park and Recreation Assn. over the use of the community swimming pool.

In a ruling issued Friday, Judge Mason L. Fenton upheld the association’s decision to allow a youth swim team to hold practices many summer weekdays and some weekend days at the village’s junior Olympic-sized lap pool.

The ruling disputes claims from the plaintiff, Turtle Rock homeowner Alisa Ross, that the association deprived other residents from using the pool by allowing the Sharks to monopolize the swimming complex during the summer.

Ross sued the association nearly a year ago to protect homeowners from liability and to secure pool use for swimmers who don’t belong to the Sharks.

Ross had not yet seen the ruling by late Monday. She has 60 days to appeal the decision, but said she wasn’t sure whether she would pursue any further legal action.
