Man Sentenced in Software Pirating Case

A Laguna Hills man who pleaded guilty to federal charges of making, labeling and selling counterfeit Microsoft Corp. software was sentenced Monday to seven months in prison.

Adrian Frederick Herr, 30, also will be required to pay $30,000 restitution and complete 300 hours of community service, according to Assistant U.S. Atty. David Lavine.

Herr admitted in February that he copied the programs, including Windows 98 and Windows 2000, without Microsoft’s permission. Prosecutors said Herr advertised his copies on the Internet and sold the counterfeit software from his house.

Herr had been caught previously, agreeing in April 2000 to stop selling the software in exchange for avoiding prosecution.
