A grand jury in Cleveland indicted a Franciscan brother on charges he fatally shot a Roman Catholic priest and set his office on fire last month.

Daniel Montgomery faces two counts each of aggravated murder and aggravated arson. Prosecutors have said they plan to seek the death penalty.

Montgomery has been in the Cuyahoga County Jail since he was arrested Dec. 8, one day after Father William Gulas of St. Stanislaus Church was shot and the church rectory was set on fire.
