Ban on Unsolicited Faxes Upheld

A U.S. appeals court upheld a federal ban on unsolicited commercial faxes, finding that the 1991 law doesn’t violate free-speech rights.

The St. Louis-based 8th U.S. Circuit Court of Appeals ruled in favor of Missouri’s attorney general in reversing a trial court’s finding that the law violated free speech rights.

Missouri sued American Blast Fax Inc. of Dallas and Fax.Com Inc. of Aliso Viejo in 2000, in response to complaints by consumers and small businesses annoyed by unwanted faxes. The companies could not be reached for comment.
