There’s Nothing Civil About Bryant Case

So Kobe’s accuser now wants to simply sue him for consensual sex she later regretted? How is that fair? Please. This criminal trial was never going to happen, because the accuser has no case, and never did. This girl is no “victim.” We throw around that word much too easily these days. Victim? Her? Only if “victim” is a euphemism for “shameless opportunist.”

Gee, I thought Kobe’s accuser said it wasn’t about money.

Her lawyers will have an almost impossible hurdle to overcome in the civil lawsuit the woman filed. On the assault cause of action, they will have to show intent to cause harm and that she did not consent. On the defamation cause of action, Kobe is not the one who made any statements imputing unchaste behavior toward a woman, and truth is an absolute defense.

I am reminded of the old saw about a man propositioning a woman for $100,000 (the equivalent of a tryst with a star) to which she agrees. When he whittles her down to $100, she exclaims, “What kind of girl do you think I am?” He replies, “We’ve already established that; we’re only haggling over the price.”

Regarding the jury pool in Kobe Bryant’s upcoming sexual assault trial, there’s probably a good reason why the citizens of Eagle County claim to know little about the case: They’re too busy selling hotel rooms, food and booze to members of the frenzied media.
