Clerks, Gay Couples Challenge Marriage Law

Eight couples and more than a dozen municipal clerks filed lawsuits challenging the 1913 law used to block out-of-state gay couples from marrying in Massachusetts.

The law bars couples who live outside Massachusetts from marrying in the state if their marriages would be illegal in their home states. Gov. Mitt Romney and Atty. Gen. Tom Reilly cited the law in denying marriage licenses to out-of-state gay couples.
