From Times Wire Reports

A court ordered an 86-year-old man accused of Nazi war crimes in Slovakia freed from custody during his trial after a key witness said he could no longer clearly remember what happened.

Former Capt. Ladislav Niznansky still faces 164 counts of murder in massacres of civilians in three villages in early 1945, and the trial will continue. But Niznansky’s lawyer, Steffen Ufer, said the decision indicated that he would probably be acquitted.

Prosecutor Konstantin Kuchenbauer disagreed, noting that more witnesses and evidence must be heard.
