Lindsay Lohan battery case will go to prosecutors

Lindsay Lohan‘s exit from rehab may become a moot point, as detectives in Riverside County said Tuesday they’ve found enough evidence in a criminal battery investigation to forward the case to prosecutors.

A two-week investigation of the Dec. 12 altercation with rehab tech Dawn Holland ‘determined Ms. Lohan violated several aspects of her probation, including the battery,’ said the Riverside County Sheriff’s Department, L.A. Now reports. The case against the actress is expected to go to prosecutors ‘later this week.’


The deal that allowed Lohan to stay out of jail after failing two court-ordered drug tests -- all still arising out of two 2007 DUI arrests, mind you -- in part required that she ‘obey all laws.’ She was also ordered to stay in rehab until Jan. 3 at the Betty Ford Center in Rancho Mirage. And the consequences of blowing it? That’d be a trip back to jail, courtesy of Judge Elden Fox.

Holland said that Lohan -- after returning to a Betty Ford sober house after curfew and refusing a Breathalyzer test -- had pushed her, thrown a phone at her and twisted her wrist hard enough to send her to the emergency room. The story went public on Dec. 21, with Lohan lawyer Shawn Chapman Holley saying the next day only that her client had called 911 first.

Holland was fired on Dec. 21 for violating patient confidentiality after giving an interview to website TMZ; on Dec. 24 her lawyer said Holland, an eight-time rehab veteran, had no interest in pressing on further in the case. However, only law enforcement can decide to truly ‘drop charges’ in a criminal case.

Despite early reports that she would stay at Betty Ford past her get-out-of-rehab date, Lohan is said to have left the facility Monday and spent her first night of freedom in an L.A. hotel while her new Venice home -- reportedly near ex Samantha Ronson‘s place -- was readied.
