A state appellate court has upheld the constitutionality of a California law that bans judges from ordering psychiatric tests of alleged sexual assault victims. Attorneys appealing the rape conviction of Allen Ray Armbruster in Placer County argued that the law, which went into effect in 1980, denied Armbruster basic rights assured by the state and U.S. constitutions. Before the jury trial, attorneys had unsuccessfully sought an order requiring the victim to undergo psychiatric tests. The 3rd District Court of Appeal in Sacramento issued a unanimous decision, saying the absence of tests did not prevent a fair trial.
