The Justice Department said today a proposed merger of the Norfolk Southern Railroad and Conrail would pose no antitrust problems as long as Norfolk Southern sells certain sections of track where the two railroads now compete.

Transportation Secretary Elizabeth Hanford Dole has been awaiting the Justice Department findings before she selects among the three potential buyers of Conrail, including the Alleghany Corp. and and an investment group headed by hotel executive J. Willard Marriott. An announcement on a purchaser is expected early next week.
