A preliminary injunction was granted in Bridgeport to prevent the Los Angeles Department of Water & Power from diverting water from Mono County’s Rush Creek, pending a May 3 hearing on whether the ban should be made permanent. The action by Siskiyou County Superior Court Judge David Otis sitting in Mono County was hailed by the Mono Lake Committee as “a significant first step” in securing enough water for survival of the lake. They contend that thousands of trout in Rush Creek, a tributary of the lake, would be endangered by diversion. The creek has been diverted into the aqueduct most of the time since the 1940s, but has been allowed to flow into the lake for the last three years because of the heavy snow pack.
