A New York judge has permanently barred a Costa Mesa mail-order blood-testing laboratory from doing business in that state after it was accused of being unable to tell the difference between cow blood and human blood.

The ruling Friday by state Supreme Court Justice Harold Hughes bars Bio Health Centers from operating in the state unless it gets a valid permit from the state Health Department. Supreme courts are trial-level courts in New York.

The New York State Health Department refused to give Bio Health a valid permit because it does not consider the company’s testing procedure, which it calls Cytotoxic III testing, to be scientifically valid, said Nathan Riley, a spokesman for state Atty. General Robert Abrams.

Under the testing procedure, Bio Health charged $350 to test blood for allergic reactions to food. Customers had to mail their own blood sample to California.

Abrams sent a sample of cow blood to the laboratory, saying it was his own and was told he was allergic to 22 substances, including cow’s milk.
