U.S. Ruling Asked on Cable TV Fees
Group W Cable on Tuesday requested that a federal judge settle a dispute between it and the City of Fullerton over a proposed $3.50 increase in customers’ monthly service rates.
The New York-based company wants a federal court, not a state court, to hear Fullerton’s request for a temporary injunction against the rate increase because the company operates franchises nationwide, said attorney Larson Jaenicke.
The city is seeking to bar the company from raising its basic monthly rate from $6.45 to $9.95. A hearing is scheduled for May 20 before Judge Irving Hill in U.S. District Court in Los Angeles, Jaenicke said.
A temporary injunction would prohibit Group W from raising rates until a judge hears the case, originally scheduled to be heard Tuesday in Orange County Superior Court.
Fullerton city officials have said the rate increase would violate the company’s contract with the city.
