Man Shot by Goetz Asks Dismissal of Charges

Lawyers on Tuesday asked a judge to dismiss armed robbery charges against one of four young men who were shot on a subway train by Bernhard H. Goetz, saying he is unable to stand trial because of his injuries.

Darrell Cabey, 19, suffered paralysis and brain damage after Goetz, who faces attempted murder charges, shot him and three others Dec. 22.

Cabey at the time was free on bail on the robbery charges, which involve a holdup in the Bronx in October, 1984. He has pleaded not guilty.
