Shocking Story of the Dalkon Shield Scandal

Share

I commend the excellent feature on Page 1 (Aug. 22) concerning the shocking story of the A.H. Robins Co. Dalkon Shield scandal. As a trial lawyer, I find that it is very difficult for the public to imagine that a company with any form of a social conscience could not only market an insidiously defective product after having received prior market reports indicating the severe questions as to its safety, but thereafter order the destruction of its company records in an continuing cover-up of the truth while at the same time stonewalling the courts and victims as to its responsibility.

What comes through loud and clear, however, is a testimonial to the purpose and effect of our legal system: Through the efforts of victims, judges and trial lawyers, a national disgrace was uncovered--a defective product was recalled and thousands of victims have received compensation for devastating injuries.

The only continuing disgrace is the attempt by the Robins company to declare bankruptcy and thereby avoid further responsibility.

This story should be well remembered in the context of the well-orchestrated public furor over changing the jury system, product liability laws, etc.
