The city Redevelopment Agency has approved an agreement that ends almost five years of litigation over the condemnation of San Dimas Ready Mix Co. to make way for a shopping center, and requires the concrete-making company to vacate the property by Oct. 14.

The Ready Mix site at 536 W. Arrow Highway was condemned more than a year ago through eminent domain proceedings to make way for the 12-acre shopping center. Ready Mix tried unsuccessfully to prove in court that the plant itself was not included in the Redevelopment Agency’s condemnation purchase and asked that the agency pay Ready Mix’s relocation costs.

Under the settlement, Ready Mix will receive $18,000 for relocation expenses, half of which will be paid by the developer of the shopping center, Gary Kanter & Associates.

Ready Mix previously had been granted two extensions on the order to vacate property, and City Manager Robert Poff said that if the business has not moved by the Oct. 14 deadline, it will be evicted.
