Laguna Beach : Nestande’s Son Booked in Alleged Altercation

The 24-year-old son of Orange County Supervisor Bruce Nestande was jailed on suspicion of assault and drunk driving early Thursday on suspicion of trying to kick a Laguna Beach patrol officer who had stopped him for speeding, police said.

Barry Ken Nestande was booked into the Orange County Jail on suspicion of assaulting a police officer, drunk driving, driving on a suspended license and providing false information to a police officer, Laguna Beach Sgt. Linda Parker said. He was later released on $1,500 bail.

It was the third time the younger Nestande has been arrested for a drinking-related offense since he was placed on probation after a 1982 conviction for assaulting a man with a wrench at a fraternity brawl at Cal State Fullerton.

Nestande was sentenced to 60 days in jail in February, 1984, after being convicted for public drunkenness in Newport Beach. He received another 60-day sentence for violating his probation in January, 1985, when he was arrested on suspicion of drunk driving.

His most recent arrest occurred at 3:24 a.m. Thursday, when he was clocked by a police radar driving 84 m.p.h. in the 2700 block of South Coast Highway in Laguna Beach, a 45-m.p.h. zone, Parker said.

Nestande did “poorly” in a field sobriety test, Parker said. Once handcuffed, she said, Nestande “became combative and tried to kick” Officer Brian Kelso several times.

He was charged with providing false information to a patrol officer when he gave his name as Brian Nestande, Parker said.

Parker said the case will be turned over to the district attorney’s office, which will decide if Nestande will be prosecuted.

Nestande, who told police that he is unemployed and lives in Orange, is one of Supervisor Nestande’s three children.
