The U.S. Justice Department went to trial in Birmingham, Ala., in support of white firefighters who contend the city’s affirmative action program made them victims of reverse discrimination. The case in which the department is intervening is a consolidation of a lawsuit filed by two white firefighters, James A. Bennett and Robert K. Wilks. The plaintiffs contend they were improperly passed over for promotions in favor of black workers.
