Appeal Court Upholds Jury Damage Award

A $1.25-million damage award made by a jury to a Sherman Oaks realtor who claimed he was cut out of a sales commission, was affirmed last week by a three-judge panel of the state Court of Appeal in San Francisco.

The general and punitive damages were awarded to Gerard Morrow and his firm, Morrow & Co. Inc. in April, l984 in Contra Costa County Superior Court. Morrow contended that he had been deprived of a $530,000 commission in the 1980 sale of a 720-unit apartment building near Lake Merced in San Francisco, although he had brought buyer and seller together, according to his attorneys, Richard L. Perez and Sandra J. McNabb.

The jury verdict, which was appealed, was brought against Marina del Rey-based Traweek Investment Co., Richard Traweek, its president, and S.V. Traweek, his father. Attorneys for Traweek said they had no comment until they have reviewed the court’s written opinion.
