Thousands of containers of ice cream, ice milk and sherbet recalled from 463 Lucky and Gemco supermarkets in California, Nevada and Arizona were just sitting in freezers, and Lucky Stores Inc. executives had not decided what to do with them.

Nonetheless, they were happy, since state food and agriculture investigators had given their ice cream factory in Buena Park a clean bill of health, and production had resumed.

The glass shards that consumers reported finding in their Lady Lee and generic brand ice cream in Oakland, Modesto, Sacramento, Bakersfield and Phoenix could not have accidentally entered the ice cream during production, investigators concluded. The plant is “designed specifically to protect the product from adulteration,” a state spokeswoman said.

Company officials, who refused to speculate on the source of the glass shards, asked the FBI to join the police investigation.
