Injury Award Limit Gains in Maryland
The Maryland Senate, acting to halt soaring liability insurance rates, has approved a bill placing a $350,000 cap on “pain and suffering” awards in all personal injury cases.
The state Senate approved the measure late Saturday by a 36-9 vote. Lawmakers said if the House passes the measure it would make Maryland the first state to limit all types of personal injury awards. House and Senate conferees already have agreed on the cap.
Other states have moved to place a limit on non-economic awards in medical malpractice cases, but the Maryland bill would limit non-economic awards--for disfigurement, pain and suffering--in all personal injury cases. Payment of lost wages and medical care would not be limited under the bill.
The South Carolina Legislature is considering a bill limiting awards in all liability cases to $250,000.
