A New York State appeals court affirmed the dismissal of attempted murder and assault charges against Bernhard H. Goetz, accused of the Dec. 22, 1984, shooting of four teen- agers he thought were about to rob him on a subway train. Manhattan Dist. Atty. Robert M. Morgenthau said he would now appeal the ruling to the state’s highest court. The appellate court agreed that the 39-year-old electronics technician reasonably believed he was in danger and had the right to use deadly defensive force.
