County supervisors on Wednesday agreed to phase in a large and controversial residential development in Encinitas to protect an overcrowded school district from a sudden surge in enrollment.

The Board of Supervisors voted 4-0, with Susan Golding absent, to ratify an agreement reached after the Encinitas Union School District filed suit against James Bashor, the first developer to take advantage of a zoning change permitting increased densities in the Quail Gardens area of Encinitas.

The supervisors approved an ordinance limiting building permits in the area to 200 per year for the next two years, a policy that school district officials said would limit additions to the school system to 40 pupils a year.

The zoning change could lead to the addition of 700 students to the six-school system, district officials have said.
