The parents of a baby born with cerebral palsy and other disabilities filed a $100-million lawsuit claiming that the drug DES, used by the infant’s grandmother in 1954 to prevent a miscarriage, caused the birth defects. The suit against seven firms that made DES was filed by Stephanie Kanarek-Smith and David Smith, the parents of Amy Smith, in New York state Supreme Court. It is the first lawsuit claiming third-generation effects of DES use. It claims the drug caused the baby’s mother to be born with a uterine deformity that led to the infant’s physical impairments.
