2nd Governor Runoff in Alabama Denied

The Supreme Court on Tuesday turned down an emergency request by Alabama Atty. Gen. Charles Graddick that it order a second runoff to choose a Democratic nominee for governor.

The justices, without comment and without a dissenting vote recorded, let stand a ruling that leaves Lt. Gov. William J. Baxley as the party’s nominee for governor in the Nov. 4 general election.

Graddick apparently won the Democratic runoff June 24, receiving 8,756 more votes than Baxley. But a five-member Democratic panel ruled Aug. 15 that Republican voters illegally crossed over to support Graddick. The panel awarded the nomination to Baxley.

Gov. George C. Wallace is retiring. The Republican candidate is Guy Hunt.
