A judge dismissed two of eight felony charges against a security guard accused of killing Jeanine Grinsell, 16, and attempting to kill Laurie McKenna, now 19, after agreeing to take them on a tour of the abandoned 92-room Carolands Chateau mansion Feb. 2, 1986. San Jose Superior Court Judge John Schatz said the evidence was insufficient to try David Allen Raley, 25, on charges of attempted rape and assault with intent to commit rape. He also dismissed a special circumstance allegation of murder in the act of rape. Raley still faces charges of murder, attempted murder, oral copulation, attempted oral copulation and two counts of kidnaping, with three special allegations that could mean the death penalty.
