Penn Juror Is Dismissed After Death in the Family

A juror in the Sagon Penn retrial was dismissed Monday because of a death in her family.

Replacing Kathleen Bybee was alternate juror Emmett Cruz.

Testifying as the 42nd witness Monday was Anthony Lovett, who lived on Brooklyn Street and witnessed some of the March 31, 1985, altercation between Penn, 25, and two police officers.

Penn is charged with manslaughter, attempted murder, attempted manslaughter, and assault with a deadly weapon in connection with the incident.

Lovett said he didn’t see Penn shoot Police Agent Thomas Riggs, who died at the scene; Agent Donovan Jacobs, or civilian ride-along Sarah Pina-Ruiz.

He said he thought Penn had been shot when he heard the shots being fired.

Lovett quoted Jacobs as saying, “You think you’re bad, boy?” to Penn after Penn failed to surrender his driver’s license to Jacobs.
